The H-2B temporary non-agricultural program allows U.S. employers who meet specific regulatory requirements to bring foreign nonimmigrant workers to the United States to fill temporary nonagricultural jobs. Before requesting H-2B classification from the U.S. Citizenship and Immigration Services (USCIS), the employer must apply for and receive a temporary labor certification for H-2B workers from the U.S. Department of Labor (DOL) (or Guam DOL, if the employment will be in Guam). 

• Submit your job order to the State Workforce Agency (SWA) serving the area of intended employment no more than 120 calendar days before your date of need. 

Who May Qualify for H-2B Temporary Non-Agricultural Program. 

In order to receive an H-2B temporary labor certification, the employer must establish that:

• There are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work.
• The employment of H-2B workers will not adversely affect the wages and working conditions of similarly employed U.S. workers.
• Its need for the prospective worker's services or labor is temporary, regardless of whether the underlying job can be described as temporary. With the exception of a one-time occurrence need that could last up to three (3) years, temporary need will not be approved for longer than 10 months. Administered by the U.S. Department of Labor, the H-2 visa program was established to bring foreign workers to the U.S. to fill temporary positions for agricultural (H-2A) and non-agricultural (H-2B) employers, primarily for the hospitality and service industries. The program helps provide a legal and stable workforce for both U.S. farm and non-farm employers who anticipate a lack of available domestic workers.

The H-2 visa process can be cumbersome for employers. That’s where FLECTS relies on its more than three decades of experience to help companies navigate the various filings and requirements of the program with a focus on Mexico and Jamaica recruitment. For both the H-2A and H-2B visa programs, FLECTS provides filing and certification services, arranges embassy appointments, arranges transportation, provides recruitment services, and more. FLECTS recruits temporary workers from Jamaica, Mexico, the Caribbean and South America using the U.S. Department of Labor H-2 visa program. In fact, FLECTS has a representative based in Jamaica to recruit workers. FLECTS then helps to administratively process workers, including recruitment and transportation, to ease the burden on employers.

There are several fees associated with obtaining an H-2 visa, including a consulate fee, agent fees, filing fee and more. Once a visa is obtained, employers are then responsible for transportation, housing and subsistence. The total cost varies per employer.
